Acceptable Use Policy Revised 6.15.2005
1.

| Introduction This Acceptable Use Policy ("AUP") has been created by iVisionWeb, LLC (“iVisionWeb”) and is intended to help improve the use of the Internet by preventing unacceptable use. All users of iVisionWeb’s web services of any kind (“Services”) must comply with this AUP. iVisionWeb supports the free flow of information and ideas over the Internet and does not actively monitor use of its Services under normal circumstances, with the exception of websites critical to iVisionWeb’s business operations. Similarly, we do not exercise editorial control over the content of any website, electronic mail transmission, news group, or other material created or accessible over or through our Services, except for certain proprietary websites. However, iVisionWeb may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this AUP. iVisionWeb may cooperate with legal authorities and others in the investigation of any suspected crime or wrongdoing. You acknowledge that iVisionWeb may preserve and disclose the content of a website if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to comply with legal process, enforce our agreements or policies, respond to claims that the content violates the rights of third parties, or protect the rights, property or personal safety of iVisionWeb, our users and the general public. You further agree that you must evaluate, and bear all risks associated with the use of any Internet content, including any reliance on the accuracy, completeness and usefulness of such content. Violations of this AUP may result in actions including the suspension or termination of your account. This AUP is incorporated in our services agreement and other policies. This AUP is a guideline and is not an all-inclusive listing of prohibited conduct.
| | 2. | Violations of iVisionWeb's AUP As the following constitute violations of this AUP, you agree not to use or attempt to use any of iVisionWeb’s Services to:
| » | Use Services to transmit any material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder.
| | » | Harm, or attempt to harm, minors in any way.
| | » | Threaten or encourage bodily harm or destruction of property.
| | » | Stalk or harass another person.
| | » | Use Services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters."
| | » | Violate any regulations promulgated by the U.S. Securities and Exchange Commission, or any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law.
| | » | Forge header information or impersonate another person. Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation. Using deliberately misleading headers ("munging" headers) in news postings in order to avoid spam email address collectors is allowed.
| | » | Disseminate “spam” or any type of unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email, whether or not that email is commercial in nature, are prohibited.
| | » | Gain or attempt to gain unauthorized access to the accounts of others, or to penetrate, or attempt to penetrate, security measures of iVisionWeb's or another entity's computer software or hardware, electronic communications system, telecommunications system, or data system of any kind, whether or not the intrusion results in the corruption or loss of data.
| | » | Distribute or take actions that might result in the distribution of information, software, or other material that is protected by copyright, trademark, patent, trade secret, any other type of intellectual property rights, trademark laws (by rights of privacy or publicity) or other proprietary right of any party unless you own or control the rights or have obtained consent to do so. This includes using any material that you do not have a right to make available under any law, contractual or fiduciary relationship (including inside information, proprietary and confidential information learned as part of employment relationships or under other nondisclosure agreements). This prohibition also includes the use of any material or information including images or photos that are made available through a Service of iVisionWeb’s, digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
| | » | Collect, or attempt to collect, personal information about third parties without their knowledge or consent.
| | » | Resell, or exploit iVisionWeb’s Services without authorization from iVisionWeb.
| | » | Adversely affect the ability of other people or systems to use iVisionWeb’s Services or the Internet. This includes "denial of service" (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is also prohibited. It is the user's responsibility to ensure that their network is configured in a secure manner. A user may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A user may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network or iVisionWeb’s Services in an illegal or inappropriate manner.
| | » | Continue posting off-topic articles, generally including commercial advertisements in most newsgroups. We reserve the right not to accept, to delete, or to cancel any postings from newsgroups where we have actual knowledge that the content of the newsgroup violates this AUP.
| | » | Using iVisionWeb’s Services for high volume or commercial use, unless authorized by iVisionWeb, is prohibited. Services are intended for periodic, active use of email, newsgroups, file transfers, Internet chat, games, and browsing the World Wide Web. Members may stay connected so long as they are actively using that connection for the above purposes. Members may not use Services on a standby or inactive basis in order to maintain a connection. Pinging is expressly prohibited. Accordingly, iVisionWeb maintains the right to terminate any connection following any extended period of inactivity as determined by iVisionWeb.
| | » | Use or implement “robots” or any other type of automated code to collect e-mail addresses in order to send unsolicited or unauthorized material.
| | » | Exceed website size or traffic limitations, as determined by iVisionWeb. Website limitations will be clearly defined on a per-user basis.
|
| | 3. | Reporting Violations of iVisionWeb's AUP iVisionWeb requests that anyone who believes that there is a violation of this AUP e-mail the information to: abuse@ivisionweb.com.
If available, please provide the following information:
| » | The IP address used to commit the alleged violation
| | » | The date and time of the alleged violation, including the time zone or offset from GMT
| | » | Evidence of the alleged violation
| E-mail with full header information provides all of the above, as do syslog files. Other situations will require different methods of providing the above information.
iVisionWeb may take any one or more of the following actions in response to complaints:
| » | issue warnings: written or verbal
| | » | suspend the Member's newsgroup posting privileges
| | » | suspend the Member's account
| | » | terminate the Member's account and delete any associated data, without refund
| | » | bill the Member for administrative costs and/or reactivation charges
| | » | bring legal action to enjoin violations and/or to collect damages, if any, caused by violations.
|
| | 4. | Security iVisionWeb relies on you to help ensure the security of your network. Ensuring that users use Services appropriately is your responsibility. You must take all necessary steps to manage the use of Services obtained from iVisionWeb in order to minimize any network abuse.
Criminal and civil liability may result if system or network security is violated. Incidents involving such violations will be investigated and iVisionWeb will cooperate with law enforcement if a crime is suspected.
Security violations include, but are not limited to:
| » | Failing to secure your system. You are expected to configure and secure your services to prevent the disruption of service to your users. If unknown persons utilize your Services at any time to illegally distribute licensed software, you will be liable. Monitoring these services is your responsibility. Examples of unsecured services include use of SMTP relay, incorrect configuration of Proxy or SOCKS services, PC Anywhere, SNMP Broadcaster, or FTP server. You must take corrective actions on vulnerable or exploited systems to stop continued abuse. You must insure that your network and/or computer are securely configured. You may not, through action or inaction, allow others to use your network inappropriately or in violation of this AUP or the iVisionWeb services agreement for the Service(s) you purchased.
| | » | Utilizing any software or device to stay logged on while you are not actively using an iVisionWeb Service or using your account to operate a server without authorization from iVisionWeb.
| | » | Utilizing or spreading files that contain viruses, Trojan horses, worms, time bombs, cancel bots, corrupted files, or any other programs capable of harming another’s computer operation or property.
| | » | Hacking - breaking the security on another’s computer network or accessing another’s account. Such acts would include, but not be limited to, unauthorized access to, or use of, data, systems or networks, including any attempt to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without the owner’s approval.
| | » | Monitoring of data or traffic on any network or system without the owner’s express approval, including use of ‘sniffers’ or SNMP tools.
| Harmful Acts You may not engage in other activities, illegal or not, that are harmful to our users, operations, reputation, or customer relations, as iVisionWeb determines in our sole discretion.
Password Security We rely on you to keep your password secure. Any and all access to or use of the Services through your account is your responsibility. No one may attempt to obtain another user's account password.
Prohibited Affiliations You represent and warrant that you are not a resident of any country or affiliated with any other organization that is prohibited from doing business within the United States as defined and set forth at: http://www.treas.gov/ofac.
